Rising Borneo consciousness among Swak bloggers

Sabah Star chairman Jeffrey Kitingan said the rise of political consciousness in Sarawak augured well for Borneo.

KUCHING: Over 50 bloggers here met with Sabah assemblyman Jeffrey Kitingan to brainstorm over existing issues affecting the two Borneo states. Topping their discussions were the federal government’s defaults on the Malaysia Agreement and the insidious ‘amendments’ to the federal constitution and Malaya’s ‘occupation’ of Sabah and Sarawak’s natural resources. Since the historic 2008 general election and the subsequent 2011 state elections in Sarawak, political awareness has seen an increasing presence in the blogsphere.

In the run-up to last May’s general elections, Kitingan was the voice Sarawakians heard brandishing the 20 and 18 points agreements involving Sabah and Sarawak. Speaking to FMT here, Kitingan said the rise of political awareness in Sarawak especially among the younger generation was a sign of ‘emerging times’. He said the emergence of new groups such as the Sabah Sarawak Movement (SSM), Sabah Sarawak Keluar Malaysia (SSKM), United Varsity Student of Borneo (UVSB) showed that the people of Sabah and Sarawak were desperately wanting to express their concerns.

Both SSM and SSKM are active on social media and have 7,742 and nearly 10,000 members respectively. “It’s a sign of emerging times. People are beginning to question the state’s position as the 12th and 13th state in Malaysia when this is not the reality. “That these questions are being asked indicates that we have a problem that needs to be addressed,” Kitingan said. Amendments to federal constitution He said in 1963 independent sovereigns Sabah and Sarawak went into partnership with the Federation of Malaya as equals.

“The Federation was formed through 20 points and 18 points conditions, among them were  important promises to Sabah and Sarawak that they will be self-governing. “As equal partners Sabah and Sarawak were assured that we will have the power to control our resources and finances and political franchise. “But today it is no longer that and we find ourselves (Sabah and Sarawak) degraded to be just be one of state. “It has been a project takeover for Malaya,” said Kitingan. He pointed out that the federal constitution had been surreptitiously amended “around 1975 and 1976” to “totally change the concept of Malaysia”.

“The amendments turned Sabah and Sarawak into the 12th and 13th state. It was a takeover of  British colonies. “And now we are colonized by Malaya especially Sabah,” he said adding that Sarawak had managed to preserve its independence to some extend because of Chief Minister Taib Mahmud. Senior leaders in the Taib-run administration have in recent months also openly accused the Umno-led federal authorities of shortchanging Borneo and have gone as far as to call for a review of the current situation.

Meanwhile Taib’s firm stand on the ‘status quo’ of the Malaysia Agreement and the state government’s endorsement of Sarawak’s Independence Day on July 23 last year augurs well for Borneo sentiments.

The Politics of "Cari Makan" in Sabah

Arnold Puyok

Sabah politicians have always been driven by what I call as the politics of ‘cari makan’. But before I go any further, let me first explain what the politics of ‘cari makan’ means.

For Sabah politicians, politics is not about understanding people’s problems and turning those problems into policy solutions. These are not in the Sabah politicians’ vocabulary. Politics for them is simply about finding the ways and means to get access to the state’s development resources - often, in order to gain monetary benefits quickly. So, becoming a politician in Sabah is one of the fastest ways to become rich - or an instant millionaire.

When news about a former opposition assemblyperson leaving his party came out, it was hardly news at all – at least for me. This is Sabah! Sabah politicians like to ‘jump’ to ‘cari makan’. The excuses given by the assemblyperson who used expressions such as “for the people”, “for development’s sake”, “loss of confidence”, etc, etc, are not new and have become a cliché in Sabah.

But to be fair to the assemblyperson, he may have a “strong” reason to leave his party. It is his democratic choice to decide his future political direction. It may be argued that his leaving the party was for the interest of his electorate whom he thought might be better served under a more resourceful and financially able party. So, if this is the case, the assemblyperson cannot be blamed. It is the system that forces him to leave his party.

In Malaysia, opposition leaders are often relegated to a second-class status even though they are voted by the rakyat to represent them. The system is seriously skewed in that only elected representatives from the ruling party have access to the state’s development resources to develop their constituencies. This puts the opposition parties in a disadvantageous position - without sufficient financial resources, it is rather difficult to serve the rakyat’s needs satisfactorily.

There is also a question about moral principles of elected representatives. The argument against defecting to another party is that the leader has betrayed the trust of people who voted for him under the party he represented. But it may be argued that voters’ voting preference might be influenced by the candidate’s popularity than by the party’s standing.

So, rather than questioning the moral integrity of the defecting leader, the main issue here is how to increase the accountability of elected representatives so that they will not use their political position to ‘cari makan’. I suggest a number of ways.

First, parties from both sides of the political divide must use the ‘bottom-up’ approach in selecting potential candidates to run in an election. The potential candidates must be vetted from the lowest level of representation such as the village to the highest level of representation in the party. The current practice of most political parties is to choose candidates who are closer to the centre of power instead of those who are closer to the electorates.

It is also important for the potential candidates to appear in a council-type debate. The ability to debate and to articulate issues of public interest is essential to increase the accountability of elected representatives. The final stage of this process is a vetting by an independent body within the party to choose the most suitable candidate to contest in an election. The process of selecting a candidate must be done early and not one or two days before the election.

Second, potential candidates must declare their assets publicly. Assets declaration by elected representatives is part and parcel of a functioning democratic society. By declaring their assets, elected representatives may be discouraged from using the public office to accumulate wealth or to involve in commercial activities in which they may have certain hidden interests. The role of elected representatives is to serve people and not to make money.

Drawing the line on political funding

Thirdly, a law must be enacted to prevent elected representatives from using their political position to expand the business interests of their allies, family members, or other parties with whom they may have certain vested interests with.

The law must also draw the line very clearly in respect to political donation, political funding, campaign programmes, and so on to ensure that elected representatives do no take advantage of those activities mentioned to serve their own personal interests.

Fourthly, the status and prestige of the legislative assembly must be elevated. Assembly meetings should be conducted regularly, and not a one-day sitting as in the case of the recent Sabah assembly proceeding. Assembly debates should be live telecast so that the electorates can assess the performance of their representatives.

Proposed enactments should be pre-debated and previewed before they are brought to the assembly for deliberation.

All this while, most people do not have any idea about what is going on in the assembly. The general perception about assembly sittings is that they are boring, a waste of time, and do not affect the day-to-day life of public. Elected representatives have a duty to explain to the rakyat that the legislative is an important government institution as it is the ‘brain’ that determines the future of the country.

Fifthly, political parties must conduct an empowerment session or a capacity building programme to train their elected representatives.

Most of the elected representatives think their work is done after winning the election. Some spend more time at golf courses, at hotel lounges, and at karaoke outlets than in their constituencies to serve the rakyat.

Elected representatives must be trained how to debate, how to write and evaluate policies, and how to initiate grassroots-level programmes, among other things.

Finally, the government must set up a people’s tribunal as an avenue to lodge complaints against underperforming elected representatives. Most elected representatives regard themselves as “untouchable”, “semi-god”, and worse, a “boss”.

Through the people’s tribunal, elected representatives will be made accountable to the people they serve. It is also an avenue for people to speak up openly and critically about issues which their representatives fail to address satisfactorily.

It is important for elected representatives to have the moral courage to explain to people their every action - including to defect to other party or to become an independent - as in the case of the opposition assemblyperson earlier.

But what is more important is for people to be empowered so that they can hold their elected representatives accountable. People - especially Sabahans - have had enough of leaders who become elected representatives simply to ‘cari makan’. Elected representatives who merely want to ‘cari makan’ are an impediment to the country’s progress. People of all races and religions should stand up and say ‘no’ to this kind of leaders.

Enough with the threats, Jeffrey tells Najib’s men

He said the claims for the restoration of Sabah rights and autonomy do not mean cessation, or being anti-Malaya/Peninsula or promoting hatred for other Malaysians.

KOTA KINABALU: Sabah opposition leader Jeffrey Kitingan wants the federal government to stop threatening those who have spoken up for Sabah’s rights in Malaysia.

He said it could not be denied that the two Borneo states had been overlooked in terms of development and their rights denied under the terms and conditions of the Malaysia Agreement and criticisms should not be construed as unpatriotic.

“The biggest threat to the security of the nation and the break-up of Malaysia is from the ruling government itself,” he said yesterday when urging the federal authorities to acknowledge its treatment of Sabah and Sarawak.

“The more the ruling government ignore and does not address the grievances of and the injustices inflicted on Sabahans and Sarawakians and implement the Malaysia Agreement, the 20/18 Points, the IGC Report and the recommendations of the Cobbold Commission, the louder will be the voice of the people in Sabah and Sarawak.

“The official slogan may be ‘Sabah Maju Jaya Dalam Malaysia’ but the stark reality on the ground and in the kampongs is ‘Sabah Termiskin Dalam Malaysia’,” the STAR Sabah chairman, who’s outspokenness on Sabah issues has landed him in trouble before, said.

Kitingan also contended that if the government wished to take action against perceived “threats to the security and well-being of the nation”, it should look into the statements and threats issued by personalities and groups in the name of Malay rights.

He said such jingoistic terms as Ketuanan Malayu as well as the religious bigots that incite religious hatred and racism are far more dangerous but have been ignored.

The failure of Minister of Defence Hishammuddin Tun Hussein to speak out on those issues, he said, could be construed as arrogance and an abuse of power to lord it over and control Sabahans to ensure Umno and Malaya’s dominance and colonisation over Sabah.

“There is nothing criminal or wrong in any Sabahan/Sarawakian to seek the restoration of the rights, privileges and autonomy of the Borneo States that were taken away or eroded since 1963,” he said.

“The Minister seems to have forgotten the facts of history that Sabah and Sarawak (with Singapore then) formed Malaysia in 1963 and were given various promises and assurances by the then Malayan leaders including the execution of the Malaysia Agreement to induce and entice the Borneo States to form Malaysia.
“Malaysia never existed before 1963 and Malaysia would not have existed even today without Sabah and Sarawak,” Kitingan pointed out.

Critics are not anti-Malaya

He said the claims for the restoration of Sabah rights and autonomy do not mean cessation, or being anti-Malaya/Peninsula or promoting hatred for other Malaysians.

“Claiming for Sabah rights is nothing more than the equivalent claim for Malay rights in the Peninsula.  Claiming for these rights also does not mean ‘Sabah for Sabahans’ or ‘Sarawak for Sarawakians’.

“It is not even a shadow of a threat to the security and well-being of the nation although it may seem to be a political threat to the political powers that be.

“A political threat just like the political threat posed by Pakatan Rakyat to the ruling regime does not mean a threat to the nation or security of the nation.

“Such a political situation is but part and parcel of a democracy.  However, the ruling regime does not see it that away and used every possible government machinery to bully, harass and intimidate the opposition,” he said.

The Bingkor assemblyman also advised the Minister concerned to take a lesson from the Prime Minister and realise the realities of the political power wielded by the Borneo States and its people including the local BN leaders.

“The people in the Borneo States have awakened from their slumber and now realise that their roles as kingmakers in determining the federal government in Putrajaya and along with it the God-given opportunity to voice and claim the restoration of the rights and autonomy of the Borneo States.

“Sack the ministers and deputy ministers from Sabah and Sarawak today and immediately the ruling BN regime will find itself in the opposition with the Minister himself as the “shadow” minister in the opposition cabinet,” he said.

Kitingan continued that the claims for restoration of Sabah rights and autonomy are beyond harassment and threats by the ministers and the government machinery.

He further noted that the people of Sabah including Sabah Umno/BN leaders and supporters are already joining the bandwagon to seek the restoration of the Sabah rights.

“Even the claims for the return of the oil rights and oil revenue, taken 95% by Petronas and the federal government with RM58 billion taken in 2012, can no longer be ignored.

“Promises of development, 1 or 2 ‘Tangki Biru 1-Malaysia’, a few pieces of zinc and timber, a few million here and there, a few hundred million of projects here and there, will no longer satisfy the people in Sabah and Sarawak. It will be more evident come the 14th general election,” he said.

Agenda Borneo Memartabatkan Maruah Negara Sabah

Pairin denies likening BN leaders to ‘buffaloes led by the nose’

PENAMPANG: Deputy Chief Minister Tan Sri Joseph Pairin Kitingan has categorically denied an allegation that he had described Barisan Nasional (BN) leaders as ‘kerbau dicucuk hidung’ (buffaloes led by the nose) to constituents in Tambunan.

The Parti Bersatu Sabah (PBS) President was upset by the allegation which was posted on Facebook two days ago.

“I was quoted as saying it during a speech in Tambunan but I don’t know where this was alleged to have happened,” Pairin told reporters at the PBS headquarters here on Friday.

He was referring to the posting on the “1 Suara Sabah” Facebook page which claimed Pairin had said: “Rakyat Tambunan dah pintar-pintar dan pandai buat pilihan masing-masing…

However, Pairin contended that what was posted in Facebook by 1 Suara Sabah was a blatant lie aimed at undermining his loyalty and support to Barisan Nasional under the leadership of Prime Minister Datuk Seri Najib Tun Razak and Sabah Chief Minister Datuk Seri Musa Haji Aman.

Pairin asserted that he had always mentioned in his speeches of his firm stand that the rakyat should give their full support to BN and its candidates.

“I have never said that we in BN are akin to ‘kerbau dicucuk hidung’ and told the rakyat to vote for the opposition,” the Infrastructure Development Minister said.

He reiterated his support for Najib by saying that the Prime Minister has a clear vision which clearly reflected his concerns for the people in Malaysia especially in Sabah and Sarawak.

“Under Najib’s leadership, we can see numerous efforts taken to address the problems and needs of the people in the two east Malaysian states,” Pairin said adding that Najib never tired of going down to the ground and meeting the people so that he can listen to their problems, suggestions, criticism and opinions.

And he has taken steps to transform the country and government through the various laboratories spearheaded by PEMANDU, Pairin said adding that those participating in these laboratories included the private sector whose opinions and feedback are needed to find solutions to problems affecting the people.

“This means that the Prime Minister and the BN government are really concerned about the people and have the desire to improve the living standards of people in Sabah and Sarawak.

“I have ensured that all the programs are implemented successfully as I can see that the Prime Minister’s efforts in the implementation of the programs are done with sincerity. I believe that the current BN leadership has the same noble intention like PBS.

“This is why I have no hesitation to say here that the rakyat should evaluate the current BN leadership wisely… look at the Prime Minister and BN’s vision and give support to all the good efforts which are aimed at improving the economy of both Sabah and Sarawak,” he stressed.

According to Pairin, the Opposition has its own method as well as agenda through which they hope to get the people’s support and this included making attractive promises.

“But through my experience, the opposition is not to be trusted… it is not as if we do not know who the opposition is as they have always been showing that they are not sincere and some of them are involved in efforts to spoil and discredit the state.

“Then there are those who tell people in Sabah not to support BN but say the exact opposite when they are in Sarawak. This is just one of the examples to show that the opposition is not sincere and does not have real principles or a firm stand,” Pairin said.

It is because of all this that the rakyat should continue to support BN and its current leadership as they have shown just how concerned they are for the rakyat’s welfare, he stressed.

MALAYSIA tidak pernah merdeka!

MALAYSIA tidak pernah merdeka! Mengapa? Pernahkah Malaysia dijajah?

Dengan panjang lebar saya bertanya, menjelaskan dan berkata-kata, mudah saja mereka memberi jawaban, “Sorry, I don’t like politic.

Check influx of Malayan civil servants to Sabah – DATUK DR. JEFFREY KITINGAN (STAR)

By Matthias Hermes
Jeffrey01
KOTA KINABALU: The Sabah government must assert its authority and stamp out any attempt to impose imported Malayan hegemony over Sabah and her citizens, said STAR Sabah Chief Datuk Dr. Jeffrey Kitingan.

He stressed this while voicing his concerns over the sudden and unusual transfer of 7 non-Malay Sessions judges/magistrates to the Peninsular.
Describing it as highly unusual, Jeffrey (photo) said the consequential replacements with Malayans raise doubts and questions over the motives of the federal leaders in their treatment of Sabahans and Sarawakians.
“Is this part of the Federal government’s Malayanization programme? Isn’t their replacements contradictory with the Borneonization set out under the 20-Points and the Malaysia Agreement,” he asked.
The Bingkor Assemblyman asserted that the issue of transfers, Borneonization and rights of Sabahans/Sarawakians are important aspects of the special rights and privileges of Sabah and Sarawak agreed in the formation of Malaysia.
“Is there no government in Sabah to look after Sabahans? Has the Sabah government been consulted? Is the Sabah government aware of this? Has the Chief Judge of Sabah and Sarawak being consulted?” he queried.
“It seems to me that the Federal government no longer respect the special rights and privileges of Sabah and Sarawak.
“I would like to know what is the official stand of the Sabah government,” he added.
Dr Jeffrey went on to note that more questions are raised when one considers the rumours and speculations circulating around over this transfer move by the federal judicial and legal service.
He also reminded that at the outset of the formation of Malaysia, it was agreed that there would be a High Court of Borneo, now known as the High Court in Sabah and Sarawak and the appointment of judicial officers and commissioners do not rest with the federal authorities.
He pointed out that while the lower courts officers come under the judicial and legal service commission, the federal government need to take cognizance that Sabah has its own set of local laws and customary laws and is not ruled by federal law alone.
“The land laws take cognizance of local native customary rights and the local native customary laws and are alien to Malayans, as if it is from another world compared to Sabah.
“In the dispensation of justice, Sabahans are entitled to and expect to be judged by qualified persons and knowledge of local laws and customs should a pre-requisite in Sabah,” he asserted.
He continued that the rumours and speculations over the transfer are adding fuel to the fire, where as it is, the Director of the Courts is a Muslim from Malaya and so is the Chief Registrar of the Courts which is traditionally held by a Borneo native.
“Is the transfer move an attempt to prevent a local native from being promoted?   Is the move a pre-cursor to bring in another Muslim Malay from the Peninsula?” he queried.
“Whatever the motive or objective of the transfer move and subsequent replacement exercise, the Sabah government and the Chief Judge of Sabah and Sarawak need to look into the matter and assert their authority as Sabah and Sabahans expect them to do.
“As aptly stated by the Chief Minister of Sarawak in the presence of the Prime Minister, the Sabah government must do likewise and stop any attempt to impose Malayan Muslim hegemony in Sabah.  There is no place in Sabah for such race and religion extremism,” he stressed.

Jalan raya (one way only).

Allah decision is a breach of Malaysia agreement - DATUK DR. JEFFREY KITINGAN

Datuk Dr. Jeffrey Kitingan is the Chairman of STAR Sabah and State Assemblymen for N33, Bingkor, Sabah.
He also contested in P180, Keningau and garnering 11900 strong votes

As the debate over the Allah decision rages, politicians from East Malaysia argued that the controversial Court of Appeal ruling is a breach of the Malaysia agreement.

Constitutional lawyers also weighed in on the issue, saying it was a clear case of a breach of the 1963 Malaysia agreement if East Malaysian Christians are barred from using the word Allah in any part of the federation.

Sabah State Reform Party (Star) chairman Datuk Dr Jeffrey Kitingan said the Court of Appeal ruling went against the first point of the agreement which touched on freedom of religion.

Point 1 of the 20-point condition that Sabah drew up and the 18-point condition Sarawak drew up, which Malaya had to agree to before forming Malaysia, stated that: “While there was no objection to Islam being the national religion of Malaysia, there should be no state religion in Borneo (Sarawak & Sabah), and the provisions relating to Islam in the present Constitution of Malaya should not apply to Borneo.”

Kitingan, a vocal proponent of restoring the full autonomy and rights of Sabah and Sarawak under the 20 and 18-point agreements, also pointed out that the country's first prime minister, Tunku Abdul Rahman, had given a clear assurance on religious freedom in Parliament on October 16, 1961.

He then quoted Tunku: “One reaction in the Borneo territories was that the Malaysia concept was an attempt to colonise the Borneo territories ... the answer to this was, as I said before, it is legally impossible for the federation to colonise because we desire that they should join us in the federation in equal partnership, enjoying the same status between one another, so there is no fear that Malaysia will mean that there will be an imposition of Islam on Borneo ... so everybody is free to practise whatever religion.”

Kitingan said Sabah natives marked the assurance of religious freedom in the Malaysia agreement by literally carving it in stone, the Batu Sumpah or Oath Stone.

“It essentially states that as long as this religious freedom is respected, we shall be loyal to Malaysia,” added Kitingan, who in 2010 founded the United Borneo Front (UBF), a non-governmental organisation aimed at safeguarding the rights of Sabah and Sarawak in the 20-point and 18-point agreements.

Echoing Kitingan's view that the Court of Appeal ruling had breached the agreement was Sarawak PKR chairman Baru Bian.

“This decision is a betrayal of the undertaking given to our forefathers when they agreed to join in the formation of Malaysia,” Baru said.

“The rights of Sarawakians and Sabahans were also protected in the Government Paper 'Malaysia and Sarawak' dated January 4, 1962.”
